Four Former Minneapolis Police Officers Indicted on Federal Civil Rights Charges for Death of George Floyd; Derek Chauvin Also Charged in Separate Indictment for Violating Civil Rights of a Juvenile

A federal grand jury in Minneapolis, Minnesota returned two indictments that were unsealed today. The first indictment charges former Minneapolis Police Department officers Derek Chauvin, 45; Tou Thao, 35; J. Alexander Kueng, 27; and Thomas Lane, 38, with federal civil rights crimes for their roles in the death of George Perry Floyd Jr.

  • High-Risk Series: Dedicated Leadership Needed to Address Limited Progress in Most High-Risk Areas

    Overall ratings in 2021 for 20 of GAO's 2019 high-risk areas remain unchanged, and five regressed. Seven areas improved, one to the point of removal from the High-Risk List. Two new areas are being added, bringing our 2021 High-Risk List to 36 areas. Where there has been improvement in high-risk areas, congressional actions, in addition to those by executive agencies, have been critical in spurring progress. GAO is removing Department of Defense (DOD) Support Infrastructure Management from the High-Risk List. Among other things, DOD has more efficiently utilized military installation space; reduced its infrastructure footprint and use of leases, reportedly saving millions of dollars; and improved its use of installation agreements, reducing base support costs GAO is narrowing the scope of three high-risk areas by removing segments of the areas due to progress that has been made. The affected areas are: (1) Federal Real Property (Costly Leasing) because the General Services Administration has reduced its reliance on costly leases and improved monitoring efforts; (2) DOD Contract Management (Acquisition Workforce) because DOD has significantly rebuilt its acquisition workforce; and (3) Management of Federal Oil and Gas Resources (Offshore Oil and Gas Oversight) because the Department of the Interior's Bureau of Safety and Environmental Enforcement has implemented reforms improving offshore oil and gas oversight. National Efforts to Prevent, Respond to, and Recover from Drug Misuse is being added to the High-Risk List. National rates of drug misuse have been increasing, and drug misuse has resulted in significant loss of life and harmful effects to society and the economy. GAO identified several challenges in the federal government's response, such as a need for greater leadership and coordination of the national effort, strategic guidance that fulfills all statutory requirements, and more effective implementation and monitoring. Emergency Loans for Small Businesses also is being added. The Small Business Administration has provided hundreds of billions of dollars' worth of loans and advances to help small businesses recover from adverse economic impacts created by COVID-19. While loans have greatly aided many small businesses, evidence of fraud and significant program integrity risks need much greater oversight and management attention.   • Kennedy Center Facilities: Life-Cycle Cost Analysis and Other Capital-Planning Practices Could Help Minimize Long-term Costs

    What GAO Found The John F. Kennedy Center for the Performing Arts partially or fully met most selected practices for capital planning, procurement, and maintaining its facilities, but could take action to help ensure efficiency in future projects. Specifically, in planning for maintaining and renovating its facilities, the Kennedy Center met or partially met six out of seven selected capital planning practices. For example, it developed a capital plan for its portfolio of projects, budgeted for these projects, prioritized these projects, and completed an assessment of its facilities' conditions. The Kennedy Center has not, however, updated its capital planning policies and procedures for over 15 years nor did it comprehensively analyze the life-cycle costs—such as the cost of repair, maintenance, and operations—of its projects, including the recent REACH expansion. Implementing these two selected practices would position the Kennedy Center to ensure that it has a consistent, repeatable process for managing projects effectively and that it is making decisions early in the planning of the project to minimize the long-term costs to the federal government. Kennedy Center's Original Building with the REACH Expansion Six of the Kennedy Center's nine highest cost capital projects from 2015-2020 were within 10 percent of the contract award amount, a government benchmark. But GAO found that the Kennedy Center did not have up-to-date procurement procedures or well-documented projects. Without updated procurement policies and procedures in accordance with selected practices, the Kennedy Center could apply its procurement program inconsistently. Further, without complete project documentation, the Kennedy Center lacks reasonable assurance that project requirements are met or that it established traceability concerning what has been done, who has done it, and when it was done. This omission could potentially affect the quality of the product delivered to the Kennedy Center. The Kennedy Center met most selected practices for operations and maintenance. For example, it developed an operations and maintenance plan, used a specialized information system to help manage its activities, and used automatic control systems to enhance energy efficiency. However, fully defined policies and procedures for its operations and maintenance program would better position the Kennedy Center to meet its mission to provide the highest quality services related to the repair and maintenance of its facilities. Why GAO Did This Study The Kennedy Center is a national cultural arts center and a living memorial to President John F. Kennedy. The federal government funds the Kennedy Center's capital repairs and renovations of its facilities, as well as its operations and maintenance, all of which totaled $40.4 million in regular appropriations for fiscal year 2021. The REACH expansion, built using private funds, has increased the Kennedy Center's federally funded operations and maintenance expenses. GAO was asked to examine how well the Kennedy Center manages its projects. This report evaluates the extent to which the Kennedy Center followed selected practices in its: (1) capital planning, including for the REACH; (2) procurement; and (3) operations and maintenance, including energy efficiency and facility security. GAO selected criteria from government and industry to review the Kennedy Center's documentation for three projects that GAO selected based on cost. GAO assessed the Kennedy Center's capital planning, procurement, and operations and maintenance actions against selected industry and government practices and interviewed officials.

  • VA Vet Centers: Evaluations Needed of Expectations for Counselor Productivity and Centers’ Staffing

    The Veterans Health Administration's (VHA) Readjustment Counseling Service (RCS) provides counseling through 300 Vet Centers, which can be found in community settings and are separate from other VHA facilities. RCS has set expectations for counselor productivity at Vet Centers. For example, one expectation is for counselors to achieve an average of 1.5 visits for each hour they provide direct services. However, RCS officials told GAO that they have not conducted, and do not have plans to conduct, an evaluation of the expectations. VA Vet Center Productivity Expectations for Counselors Although most counselors met the productivity expectations in fiscal year 2019, counselors GAO spoke with said the expectations led them to change work practices in ways that could negatively affect client care. For example, counselors at one Vet Center told GAO that, to meet productivity expectations, they spend less time with each client to fit more clients into their schedules. Without an evaluation of its productivity expectations, RCS lacks reasonable assurance that it is identifying any unintended or potentially negative effects of the expectations on counselor practices and client care. RCS officials told GAO that by the start of fiscal year 2021 they plan to implement a staffing model to identify criteria for determining staffing needs at Vet Centers. The model incorporates data on counselors' productivity (work hours and number of visits), and total clients to determine criteria for adding or removing a counselor position from a Vet Center. However, the model does not fully address key practices in staffing model design GAO identified in previous work. For example, the model does not include the input of Vet Center counselors, or client data associated with directors, who also provide counseling. As a result, RCS is at risk of making decisions about Vet Center staffing that may not be responsive to changing client needs. Shortages of mental health staff within VHA coupled with the increasing veteran demand for mental health services highlight the critical importance of ensuring appropriate Vet Center staffing. VHA's RCS provided counseling (individual, group, marriage, and family) and outreach services through Vet Centers to more than 300,000 veterans and their families in fiscal year 2019. In 2017, RCS implemented changes to expectations that it uses to assess Vet Center counselor productivity, setting expectations for counselors' percentage of time with clients and number of client visits. GAO was asked to review Vet Center productivity expectations for counselors and staffing. Among other issues, this report examines the extent to which VHA (1) evaluates its productivity expectations; and (2) assesses Vet Centers' staffing needs. To do this work, GAO reviewed RCS documentation regarding counselors' productivity expectations and analyzed RCS data on counselor productivity expectations and staffing, for fiscal year 2019. GAO interviewed RCS leadership, including district directors, and directors and counselors from 12 Vet Centers, selected for variation in geographic location and total number of clients, among other factors. GAO is making four recommendations, including that VHA (1) evaluate Vet Center productivity expectations for counselors; and (2) develop and implement a staffing model that incorporates key practices.   • Missile Defense: Fiscal Year 2020 Delivery and Testing Progressed, but Annual Goals Unmet

    What GAO Found In fiscal year 2020, the Missile Defense Agency (MDA) made progress toward achieving its delivery and testing goals for some of the individual systems—known as elements—that combine and integrate to create the Missile Defense System (also known as the Ballistic Missile Defense System). However, MDA did not complete its overall planned deliveries or annual testing. The figure below shows MDA's progress delivering assets and conducting flight tests against its fiscal year 2020 plans. Percentage of Missile Defense Agency Planned Deliveries and Flight Tests Completed for Fiscal Year 2020 Deliveries— In fiscal year 2020, MDA delivered many assets it had planned. Specifically, MDA was able to deliver 82 missile interceptors for 3 elements. However, MDA was not able to deliver all planned interceptors, including one originally planned for 2018 for the Ground-based Midcourse Defense program, as the program experienced delays related to qualifying parts from a new supplier. Flight testing— MDA conducted two planned flight tests, but neither was successful. The issues were due to problems with non-MDA assets, but the agency was able to collect important data. In addition, COVID-19 restrictions also affected the planned schedule. However, the delays continue a trend of MDA's inability to conduct planned annual flight testing, resulting in assets and capabilities that are subsequently delayed or delivered with less data than planned. Ground testing— In fiscal year 2020, MDA continued to implement a new ground testing approach that the agency began in fiscal year 2019. In addition, MDA successfully completed three planned ground tests demonstrating defense capabilities for the U.S., U.S. forces and regional allies. However, MDA delayed two other ground tests to future fiscal years and expects disruptions in fiscal year 2021, in part due to ongoing COVID-19 disruptions. Cyber— Despite failing to meet annual operational cybersecurity assessments since 2017, MDA canceled its planned fiscal year 2020 operational assessments, instead taking steps to implement a new approach designed to improve cyber system requirements while streamlining cyber test planning. It is premature to assess whether this new approach will achieve its intended goals. Why GAO Did This Study For over half a century, the Department of Defense has funded efforts to defend the U.S. from ballistic missile attacks. This effort consists of diverse and highly complex land-, sea-, and space-based systems and assets located across the globe. From 2002 through 2019, MDA—the agency charged with developing, testing, integrating, and fielding this system of systems—received about $162.5 billion. The agency also requested about $45 billion from fiscal year 2020 through fiscal year 2024. In fiscal year 2020, MDA's mission broadened to include evolving threats beyond ballistic missiles such as defending against hypersonic missile attacks. With the inclusion of non-ballistic missile threats, the Ballistic Missile Defense System is in the process of transitioning to the Missile Defense System. Congress included a provision in statute that GAO annually assess and report on MDA's progress. This, our 18th annual review, addresses the progress MDA made in achieving fiscal year 2020 delivery and testing goals. GAO reviewed planned fiscal year 2020 baselines, along with program changes due to COVID-19 restrictions, and other program documentation and assessed them against responses to GAO detailed question sets and program and baseline reviews. GAO also interviewed officials from MDA and various Department of Defense Combatant Commands.   • Science and Technology: Strengthening and Sustaining the Federal Science and Technology Workforce

    What GAO Found Strengthening human capital management at federal agencies, particularly those with science and technology missions, can help agencies build a diverse, highly qualified, and agile workforce. GAO's past work demonstrates three key areas for strengthening and sustaining the federal science and technology workforce. Strategic workforce planning to identify gaps and future needs. To successfully implement their missions, agencies need to identify current skill gaps and future needs in their workforce, and select the right human capital strategies to address them. However, GAO's prior work has identified science and technology workforce strategic planning challenges that agencies have not fully addressed. For example, in October 2019, GAO evaluated major agencies' implementation of cybersecurity workforce planning strategies for information technology (IT) workers. GAO found that most of the 24 federal agencies had not fully implemented five of the eight key workforce activities that GAO identified because of reasons such as competing priorities and limited resources. GAO recommended that the 18 agencies fully implement the eight key IT workforce planning activities. Thirteen agencies agreed with the recommendation, while the other five expressed a range of views; however, while some agencies have made progress, none have fully implemented the recommendation. Improving federal pay and hiring. Agencies may experience challenges in recruiting and retaining a diverse, highly-qualified workforce due to differences in pay compared to private sector employers and challenges related to the hiring process. Generally, federal agencies have seven broadly available government-wide special payment authorities to help address recruitment and retention challenges. In December 2017, GAO reported that the Office of Personnel Management (OPM) collects data on use of these authorities but had not analyzed how much the authorities help improve recruitment and retention. GAO also reported that the agency may be missing opportunities to promote strategic use of these authorities by providing guidance and tools on assessing effectiveness. Similarly, in August 2016, GAO reported that OPM and hiring agencies had not used hiring data to analyze the effectiveness of hiring authorities. Across these reports, GAO made six recommendations to assess and improve the use of pay and hiring authorities. OPM generally agreed with GAO's recommendations, and has implemented two of the six recommendations, but has not fully implemented the other four. Addressing factors that affect the federal work environment. Factors affecting the working environment may also influence agencies' ability to attract, hire, and retain personnel. For example, GAO reported in September 2020 that individuals who experience sexual harassment are more likely to leave their jobs. Also, in March 2015, GAO reported that impediments to interacting with non-federal scientific peers because, for example, of restrictions on conference participation can be a disincentive to federal employment. Agency officials told GAO that scientists and engineers establish their professional reputations by presenting research at conferences to have their work published and, without such opportunities, researchers may find federal employment less desirable. Addressing such factors could help agencies build and sustain a diverse, highly-skilled science and technology workforce. Why GAO Did This Study The federal workforce is critical to agencies' ability to address the complex social, economic, and security challenges facing the United States. However, across government, mission critical skill gaps are undermining the ability of federal agencies to carry out their missions. Federal agencies face the difficult task of staying apace of advances in science and technology while competing for talent with the private sector, universities, and non-profit research centers. GAO has had long-standing concerns about federal agencies' strategic human capital management, an issue highlighted in GAO's High Risk Series since 2001. This testimony summarizes GAO's insights based on a wide range of GAO work covering various human capital management- and science and technology-related issues from March 2015 through February 2021. In particular, the statement focuses on (1) workforce planning to help ensure agencies are better positioned to implement their missions; (2) opportunities and challenges to recruiting a diverse, high-qualified science and technology workforce; and (3) factors that can affect the work environment. For this testimony, GAO selected prior work across human capital management- and science and technology-related topics.
